Effective Date: July 06, 2024
1.1. Agreement: These terms and conditions (the “Agreement”) establish the general framework for Checkmate Roofing and Construction (“we,” “us,” or “our”) provision of residential roofing services.
1.2. Incorporation by Reference: This Agreement is intended to be read and interpreted with any signed estimates, invoices, and residential or commercial service agreements provided by Checkmate Roofing and Construction. These additional documents may contain details specific to your project and supersede any conflicting terms within this general agreement.
2.1. Scope of Work: We will provide residential roofing services as detailed in the written estimate or contract provided to you. This includes materials and labor required to complete the project.
2.2. Change Orders: Any changes or additions to the scope of work must be agreed upon in writing through a change order document. This will reflect any adjustments to the project cost and timeline.
3.1. Down Payment: We require a minimum down payment of 50% to start all jobs. An additional upfront payment may be required if the down payment does not cover material costs.
3.2. Late Payments: Our estimates will outline specific due dates for progress payments and the final balance. While we do not assess a late fee, any remaining amount after the estimated due date will be subject to interest.
4.1. Warranty Coverage: We provide a [10-15 year] warranty on our residential roofing services. This warranty covers defects in workmanship for materials we install. Additionally, we can offer extended manufacturer warranties on certain materials, which will supersede our workmanship warranty after two years. These extended warranties’ specific terms and duration will vary depending on the manufacturer and materials chosen.
4.2. Warranty Exclusions: The warranty is void if the roofing materials are not appropriately maintained as outlined in our recommendations or if any party other than Checkmate Roofing and Construction makes unauthorized repairs or modifications to the roof. This includes, but is not limited to, roof cleaning, repairs, and other work performed by another contractor or the homeowner.
5.1. Right to Lien: We reserve the right to file a mechanics lien against your property in the event of defaulted payment. A mechanics lien is a legal claim against your property to secure payment for services rendered.
6.1. Our Insurance: We maintain general liability insurance to protect against potential damages during the project. Additionally, our workers are covered by workers’ compensation insurance.
6.2. Your Property Insurance: You are responsible for making sure that your property insurance covers any potential damages to your structure during the roofing process.
7.1. Disposal: Our estimates include removing debris and tear-off materials from the project site.
8.1. Arbitration: Any disputes arising out of or in connection with this Agreement will be resolved through binding arbitration by the Construction Industry Arbitration Rules of the American Arbitration Association (AAA).
9.1. Jurisdiction: This Agreement shall be governed by and construed by the laws of the state in which the services are performed without regard to its conflict of law provisions. We operate in the states of Missouri (MO), Tennessee (TN), Washington (WA), and Wisconsin (WI).
10.1. Integration: This Agreement, along with any signed estimates, invoices, and residential or commercial service agreements, constitutes the entire understanding between the parties regarding the residential roofing services provided by Checkmate Roofing and Construction. This does not cover Checkmate Roofing and Construction’s privacy policy.
